JUDGEMENT IN THE MATTER BETWEEN PANGANAI DZIWAKHE ON BEHALF OF ALVIN DZIWAKHE (PLAINTIFF) AND THE MEC FOR THE DEPARTMENT OF HEALTH EASTERN CAPE (DEFENDANTS)
BACKGROUND: MEDICAL NEGLIGENCE
Alvin Dziwakhe(child - 10 months old) was taken to hospital by the mother with a running stomach. A drip was inserted in his arm, but it was incorrectly sited, instead of inserting the drip in the veins, it was inserted in the artery thereby resulting in gangrene and sepsis. The child's limb had to be amputated as a result of the medical negligence. Plaintiff sued for damages.
JUDGEMENT
MEC of Health is liable for all plaintiffs' proven/agreed damages flowing from the amputation of the child. The defendant is also directed to pay the plaintiffs' costs of the action.
